4.—(1) The Tribunal Procedure (First-tier Tribunal) (Property Chamber) Rules 2013(1) are amended as follows.
(2) In rule 1(3) (citation, commencement and interpretation) in the definition “unresponsive grantor case” after the parenthesis insert “or paragraph 27ZE of Part 4ZA (code rights in respect of relevant land: unresponsive occupiers)(2)”;
(3) In rule 13 (orders for costs, reimbursement of fees and interest on costs)—
(a)for paragraph (1)(d) substitute—
“(d)in proceedings under Schedule 3A to the Communications Act 2003 (the Electronic Communications Code)(3) including proceedings that have been transferred from the Upper Tribunal.”.
(b)in paragraph (1A) for “An order under paragraph (1)(d)(ii)” substitute “In relation to proceedings that have been transferred from the Upper Tribunal, an order under paragraph (1)(d)”.
S.I. 2013/1169; relevant amending instruments are S.I. 2021/322, 1183 and 2022/1030.
Part 4ZA of Schedule 3A to the Communications Act 2003 (c. 21) will be inserted by section 67(1) of the Product Security and Telecommunications Infrastructure Act 2022 (c. 46) when brought into force.
2003 c. 21; Schedule 3A was inserted by Schedule 1 to the Digital Economy Act 2017 (c. 30), and is amended by section 1 and paragraph 4 of the Schedule to the Telecommunications Infrastructure (Leasehold Property) Act 2021 (c. 7), and Part 2 of the Product Security and Telecommunications Infrastructure Act 2022 (c. 46).
