5.—(1) Subject to paragraphs (2) and (3), the Mayor is to be treated, in relation to the Mayor’s PCC functions(1), as a police and crime commissioner for the purposes of all police and crime commissioner enactments, whenever passed or made(2).
(2) In their application to the Mayor, the police and crime commissioner enactments set out in Schedule 1 apply with the modifications set out in that Schedule.
(3) Paragraph (1) does not apply to the enactments set out in Schedule 2.
“PCC functions” is defined at section 107F(3) of the Local Democracy, Economic Development and Construction Act 2009.
“Police and crime commissioner enactment” is defined at paragraph 12(5) of Schedule 5C to the Local Democracy, Economic Development and Construction Act 2009.
