1Pŵer cyffredinol i godi ffioedd am wasanaethau gofal

(1)Caiff awdurdod lleol yng Nghymru sy'n darparu, neu'n gwneud trefniadau ar gyfer darparu, gwasanaeth y caniateir codi ffioedd amdano osod ffi resymol am y gwasanaeth (ond nid oes raid iddo wneud hynny).
(2)Ffi resymol yw'r swm hwnnw y mae'r awdurdod o dan sylw yn penderfynu ei fod yn rhesymol.
(3)Ond mae is-adrannau (1) a (2) yn ddarostyngedig i'r canlynol—
(a)adran 2 (uchafswm y ffioedd);
(b)adran 3 (personau a gwasanaethau y mae'n rhaid peidio â gosod ffioedd ynglŷn â hwy);
(c)adran 8(1) (effaith penderfyniadau sy'n ymwneud â gallu i dalu); a
(d)unrhyw reoliadau a wneir gan Weinidogion Cymru o dan adran 16 o Ddeddf Gofal Cymunedol (Rhyddhau Gohiriedig etc) 2003 (p. 5) (darparu gwasanaethau yng Nghymru yn ddi-dâl).
(4)Mae gan awdurdod lleol y pŵer i adennill ffi a osodir o dan yr adran hon.
(5)Heb ragfarnu is-adran (4) yn gyffredinol, caniateir adennill ffi a osodir o dan yr adran hon yn ddiannod fel dyled sifil.
