Changes to Legislation

Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. 10Camau i'w cymryd yn sgil asesiad iechyd meddwl sylfaenolLL+C
(1)Pan fo asesiad iechyd meddwl sylfaenol yn dynodi gwasanaethau o dan adran 9(1)(b) a allai wella iechyd meddwl unigolyn neu atal dirywiad ynddo, rhaid i'r partner iechyd meddwl lleol a gynhaliodd yr asesiad–
(a)os yw'r partner o'r farn mai ef fyddai'r awdurdod cyfrifol dros ddarparu unrhyw un neu ragor o'r gwasanaethau, benderfynu p'un a oes galw am unrhyw un neu ragor o'r gwasanaethau hynny ai peidio; a
(b)os yw'r partner o'r farn nad ef fyddai'r awdurdod cyfrifol dros ddarparu unrhyw un neu ragor o'r gwasanaethau, atgyfeirio at y person y mae'r partner o'r farn mai hwnnw fyddai'r awdurdod cyfrifol dros ddarparu'r gwasanaethau hynny.
(2)Rhaid i atgyfeiriad o dan is-adran (1)(b) hysbysu'r derbynnydd–
(a)bod y partner iechyd meddwl lleol sy'n gwneud yr atgyfeiriad wedi dynodi gwasanaethau y mae o'r farn a allai wella iechyd meddwl yr unigolyn neu atal dirywiad ynddo; a
(b)bod y partner o'r farn mai'r derbynnydd fyddai'r awdurdod cyfrifol dros ddarparu'r gwasanaethau hynny.
(3)Rhaid i berson y gwnaed yr atgyfeiriad iddo benderfynu p'un a oes galw am ddarparu unrhyw un neu ragor o'r gwasanaethau y mae'r atgyfeiriad yn berthnasol iddynt ai peidio.
(4)Yn yr adran hon ystyr “awdurdod cyfrifol” yw'r person a fyddai'n gyfrifol dros ddarparu gwasanaethau pe bai penderfyniad yn cael ei wneud i ddarparu'r gwasanaethau.
(5)Nid oes dim yn yr adran hon yn ei gwneud yn ofynnol neu'n awdurdodi gwneud atgyfeiriad i awdurdod cyfrifol, wedi ei gyfansoddi ar gyfer ardal sy'n gyfan gwbl o fewn Lloegr neu'n gweithredu ar gyfer y cyfryw ardal yn unig.
