6Dyletswyddau i gynnal asesiadau iechyd meddwl sylfaenol: atgyfeiriadau ar gyfer cleifion cofrestredig mewn gofal sylfaenolLL+C
(1)Mae'r adran hon yn gymwys i unigolyn–
(a)nad yw'n dod o fewn unrhyw un o'r disgrifiadau yn adran 8(1); a
(b)y gwneir atgyfeiriad perthnasol at ddibenion yr adran hon mewn cysylltiad ag ef.
(2)Rhaid i asesiad iechyd meddwl sylfaenol gael ei gynnal mewn cysylltiad â'r unigolyn yn unol ag adran 9.
(3)Ystyr atgyfeiriad perthnasol at ddibenion yr adran hon yw cais am i unigolyn gael asesiad iechyd meddwl sylfaenol sy'n bodloni'r amodau canlynol.
(4)Yr amod cyntaf yw bod y cais yn cael ei wneud–
(a)gan gontractiwr yr ymrwymwyd mewn contract gwasanaethau meddygol cyffredinol gydag ef o dan adran 42 o Ddeddf y Gwasanaeth Iechyd Gwladol (Cymru) 2006–
(i)gan y Bwrdd Iechyd Lleol y gwnaed y cais iddo, neu
(ii)os gwneir y cais i awdurdod lleol, y Bwrdd Iechyd Lleol sy'n bartner iechyd meddwl lleol i'r awdurdod;
(b)gan berson y gwnaed trefniadau gydag ef o dan adran 50 o'r Ddeddf honno–
(i)gan y Bwrdd Iechyd Lleol y gwneir y cais iddo, neu
(ii)os gwneir y cais i awdurdod lleol, y Bwrdd Iechyd Lleol sy'n bartner iechyd meddwl lleol i'r awdurdod; neu
(c)gan ymarferydd meddygol cofrestredig a gyflogir at ddibenion adran 41 o'r Ddeddf honno–
(i)gan y Bwrdd Iechyd Lleol y gwneir y cais iddo, neu
(ii)os gwneir y cais i awdurdod lleol, y Bwrdd Iechyd Lleol sy'n bartner iechyd meddwl lleol i'r awdurdod.
(5)Yr ail amod yw bod yr unigolyn y gwneir y cais mewn cysylltiad ag ef yn un o gleifion cofrestredig y contractiwr, y person neu'r ymarferydd sy'n gwneud yr atgyfeiriad.
(6)Y trydydd amod yw bod y cais yn cael ei wneud i bartner iechyd meddwl lleol ar gyfer ardal yr awdurdod lleol lle y mae'r unigolyn fel arfer yn preswylio.
(7)At ddibenion yr adran hon ac adrannau 7 ac 8 mae cais i'w drin fel pe bai wedi ei wneud gan contractiwr o dan gontract gwasanaethau meddygol cyffredinol yr ymrwymwyd ynddo o dan adran 42 o Ddeddf y Gwasanaethau Iechyd Gwladol (Cymru) 2006, gan berson y mae trefniadau wedi eu gwneud gydag ef o dan adran 50 o'r Ddeddf honno, neu gan gontractiwr sy'n cael ei gyflogi at ddibenion adran 41 o'r Ddeddf honno, os gwneir y cais gydag awdurdodaeth y contractiwr, y person neu'r ymarferydd.
