Erthygl 37LL+C
Rhaid i Bartïon Gwladwriaethau sicrhau:
(a)na chaiff unrhyw blentyn ei arteithio na'i orfodi i ddioddef triniaeth arall neu gosb arall sydd yn greulon, yn annynol neu'n ddiraddiol. Rhaid peidio â gosod cosb ddienyddio neu garcharu am oes heb bosibilrwydd o ryddhad am dramgwyddau a gyflawnwyd gan bersonau sydd o dan ddeunaw mlwydd oed;
(b)na chaiff unrhyw blentyn ei amddifadu yn anghyfreithlon neu'n fympwyol o'i ryddid. Rhaid i'r broses o arestio, cadw neu garcharu plentyn gydymffurfio â'r gyfraith a rhaid peidio â'i defnyddio ond pan fetho popeth arall a rhaid ei defnyddio am y cyfnod priodol byrraf;
(c)y caiff pob plentyn a amddifadir o'i ryddid ei drin â dyngarwch a pharch at urddas gynhenid y person dynol, ac mewn modd sy'n cymryd i ystyriaeth anghenion personau o'i oedran. Yn benodol, rhaid i bob plentyn a amddifadir o'i ryddid gael ei wahanu oddi wrth oedolion oni fernir y byddai er lles pennaf y plentyn i beidio â gwneud hynny a chael hawl i gadw cysylltiad â'i deulu drwy ohebiaeth ac ymweliadau, oddigerth mewn amgylchiadau eithriadol;
(d)bydd gan bob plentyn a amddifadir o'i ryddid hawl i gael mynediad buan at gymorth cyfreithiol a chymorth priodol arall, yn ogystal â hawl i herio cyfreithlondeb y weithred o'i amddifadu o'i ryddid gerbron llys neu awdurdod cymwys, annibynnol a diduedd arall, ac i gael penderfyniad buan ar unrhyw achos o'r fath.
