Misrepresentation by debt collectors123

A person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under a contract, he—

a

falsely represents that process of any court or the Office has been issued, or that any judgment has been obtained, in respect of the money claimed;

b

falsely represents, in relation to the money claimed, that criminal proceedings may be instituted for failure to pay it;

c

falsely represents himself to be authorised in some official capacity to claim or enforce payment; or

d

utters a document falsely represented by him to have some official character or which purports to have, or, by reason of its form or appearance or both, has the appearance of having, some official character which he knows it has not.

A person guilty of an offence under this Article shall be liable on summary conviction to a fine not exceedingF1 level 5 on the standard scale.
