Other interference with roads

Encamping on a road91.

(1)

Any person who without reasonable excuse encamps, or maintains an encampment consisting of a tent, caravan or any other form of shelter, on a road shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 2 on the standard scale.

(2)

Where a person has contravened paragraph (1), the Department may serve on him a notice requiring him to remove the encampment within such period as may be specified in the notice.

(3)

Where, on a complaint made by the Department, a court of summary jurisdiction is satisfied that a person—

(a)

has contravened paragraph (1); and

(b)

has failed to comply with a notice served on him under paragraph (2),

the court may make an order requiring that person to remove the encampment.
