These Regulations repeal section 5(1)(a) of the Radioactive Substances Act 1948 so that, in the application of that section by Northern Ireland, it no longer contains the power to make Regulations for the purpose of preventing injury being caused by ionising radiations to the health of persons employed at premises or places in which radioactive substances are manufactured, produced, treated, stored or used or irradiating apparatus is used or to the health of other persons.

Reference to section 5(1)(a) of the Radioactive Substances Act 1948 in Schedule 1 to the Health and Safety at Work (Northern Ireland) Order 1978 (existing statutory provisions) is omitted.

Power to make Regulations for these purposes is included in the powers contained in Article 17 of the Health and Safety at Work (Northern Ireland) Order 1978.
