SCHEDULE 10Amendments to enactments relating to the flash point of flammable liquids

1.  Petroleum (Consolidation) Act (Northern Ireland), 1929(1)

Section 23(1)

In the definition of “Petroleum-spirit”, for the words “Part IV of Schedule 1 to the Classification, Packaging and Labelling of Dangerous Substances Regulations (Northern Ireland) 1985 (S.R. 1985 No. 81) has a flash point” there shall be substituted the words “Part III of Schedule 1 to the Chemicals (Hazard Information and Packaging) Regulations (Northern Ireland) 1993 (S.R. 1993 No. 412) has a flash point (as defined in regulation 2(1) of those Regulations)”.

(i)Article I

(ii)The Schedule, Part II, paragraphs 1,2 and 3

In each place where those words occur, for the words “Part IV of Schedule 1 to the Classification, Packaging and Labelling of Dangerous Substances Regulations (Northern Ireland) 1985 (S.R. 1985 No. 81)” there shall be substituted the words “Part III of Schedule 1 to the Chemicals (Hazard Information and Packaging) Regulations (Northern Ireland) 1993 (S.R. 1993 No. 412)”.

3.  The Dry Cleaning Special Regulations (Northern Ireland) 1950(3)

(i)Regulation 2(2)

In the definition of “Flash point” the words “subject to paragraph (2A)” shall be omitted, and, for the words “Part IV of Schedule 1 to the Classification, Packaging and Labelling of Dangerous Substances Regulations (Northern Ireland) 1985 (S.R. 1985 No. 81)” there shall be substituted the words

Part III of Schedule 1 to the Chemicals (Hazard Information and Packaging) Regulations (Northern Ireland) 1993 (S.R. 1993 No. 412), except that for sub-paragraph (b) of paragraph 1 of that Part there shall be substituted the following sub-paragraph—

(b)by one of the non-equilibrium methods referred to in paragraph 4 except that when the flash point falls within the range 30°C to 34°C that flash point shall be confirmed by the use of like apparatus using the appropriate equilibrium method referred to in paragraph 3..

(ii)Regulation 2(2A)

Revoke.

4.  The Shipbuilding and Ship-repairing Regulations (Northern Ireland) 1971(4)

Regulation 3

In the definition of “Abel closed test” for the words “Part IV of Schedule 1 to the Classification, Packaging and Labelling of Dangerous Substances Regulations (Northern Ireland) 1985 (S.R. 1985 No. 81)” there shall be substituted the words “Part III of Schedule 1 to the Chemicals (Hazard Information and Packaging) Regulations (Northern Ireland) 1993 (S.R. 1993 No. 412)”.

5.  The Highly Flammable Liquids and Liquefied Petroleum Gases Regulations (Northern Ireland) 1975(5)

(i)Regulation 2(1)

For the definition of “highly flammable liquid” there shall be substituted—
  • “highly flammable liquid” means any of the following, other than aqueous ammonia, liquefied flammable gas, and liquefied petroleum gas, that is to say, any liquid, liquid solution, emulsion or suspension which—

    (a)

    when tested in accordance with Part III of Schedule 1 to the Chemicals (Hazard Information and Packaging) Regulations (Northern Ireland) 1993 (S.R. 1993 No. 412) has a flash point (as defined in regulation 2(1) of those Regulations) of less than 32° Celsius except that for sub-paragraph (b) of paragraph 1 of that Part there shall be substituted the following sub-paragraph—

    (b)by one of the non-equilibrium methods referred to in paragraph 4, except that when the flash point falls within the range 30°C to 34°C that flash point shall be confirmed by the use of like apparatus using the appropriate equilibrium method referred to in paragraph 3. and

    (b)

    when tested in the manner specified in Schedule 2 supports combustion;.

(ii)Regulation 2(2)

Revoke.
