A person who contravenes regulation 4(1) or fails to comply with any condition or requirement specified in a consent granted under regulation 4(1) shall be guilty of an offence and liable, on summary conviction, to a fine not exceeding level 5 on the standard scale5 and, on conviction on indictment, to imprisonment for a term not exceeding 2 years, or a fine, or both.
