Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Motor Vehicle Testing Regulations (Northern Ireland) 1995 (“the 1995 Regulations”) by amending fees payable as follows—

(1) Examinations—

(a)for a vehicle in Class V from £21·00 to £22·00;

(b)for a minibus from £21·00 to £22·00; and

(c)where an application is made within 21 days from the date of service of a notification of refusal and the vehicle is presented for a re-examination on the date and at a time appointed by the Department—

(i)for a vehicle in Class V from £10·50 to £11·00; and

(ii)for a minibus from £10·50 to £11·00.

(2) Full inspections under Article 81 of the Road Traffic (Northern Ireland) Order 1995 (where driving of a defective vehicle on a road has been prohibited)—

(a)for a vehicle in Class V from £21·00 to £22·00;

(b)for a minibus from £21·00 to £22·00;

(c)for a public service vehicle constructed or adapted to carry more than 12 passengers from £41·00 to £35·00;

(d)for a public service vehicle constructed or adapted to carry not more than 12 passengers from £31·00 to £35·00;

(e)for a taxi from £29·00 to £32·00; and

(f)for a trailer from £21·00 to £22·00.

(3) Tests under Article 75(5) (where vehicle has previously failed a roadside test) or a partial inspection under Article 81 of the Road Traffic (Northern Ireland) Order 1995—

(a)for a vehicle in Class V from £10·50 to £11·00;

(b)for a minibus from £10·50 to £11·00;

(c)for a public service vehicle constructed or adapted to carry more than 12 passengers from £20·50 to £11·00;

(d)for a public service vehicle constructed or adapted to carry not more than 12 passengers from £14·50 to £11·00;

(e)for a taxi from £10·50 to £10·00; and

(f)for a trailer from £10·50 to £11·00.

These Regulations also amend the 1995 Regulations by amending regulation 22 thereof, the effect of which is that the periods of 21 days and 14 days referred to in regulation 10(4) (application for re-examinations) and 15(1) (appeals) respectively are now consecutive days (previously Saturdays, Sundays and public holidays were excluded).
