The Housing Benefit (General) (Amendment No. 4) Regulations (Northern Ireland) 1996

The Department of Health and Social Services for Northern Ireland, in exercise of the powers conferred on it by sections 122(1)(d) and 129(4) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992(1) and of all other powers enabling it in that behalf, with the consent of the Department of the Environment for Northern Ireland(2) in so far as its consent is required, and after agreement by the Social Security Advisory Committee that proposals in respect of these Regulations should not be referred to it(3), hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Housing Benefit (General) (Amendment No. 4) Regulations (Northern Ireland) 1996 and shall come into operation on 8th July 1996.

(2) The Interpretation Act (Northern Ireland) 1954(4) shall apply to these Regulations as it applies to a Measure of the Northern Ireland Assembly.

Amendment of regulation 10A of the Housing Benefit (General) Regulations

2.  In regulation 10A(1)(5) of the Housing Benefit (General) Regulations (Northern Ireland) 1987(6) (determinations) for “Subject to paragraph (2), where in respect of a claim for rent allowance the Executive is determining a rent in respect of the tenancy of a dwelling it shall —” there shall be substituted “Subject to paragraph (3), in respect of a claim for rent allowance the Executive shall —”.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations further amend the Housing Benefit (General) Regulations (Northern Ireland) 1987. They provide that the Northern Ireland Housing Executive is required to consider all claims for a rent allowance under regulation 10A (determinations) (regulation 2).
