The Department of Health and Social Services in exercise of the powers conferred on it by Articles 15(1), 16(1), 25(1) and (3) and 47(2) of the Food Safety (Northern Ireland) Order 1991(1) and of all other powers enabling it in that behalf and after consultation in accordance with Article 47(3) of the said Order with such organisations as appear to it to be representative of interests likely to be substantially affected by these Regulations, hereby makes the following Regulations:—
1. These Regulations may be cited as the Food Safety (General Food Hygiene) (Amendment) Regulations (Northern Ireland) 1996 and shall come into operation on 25th August 1996.
2. Regulation 3 of the Food Safety (General Food Hygiene) Regulations (Northern Ireland) 1995(2) shall be amended as follows—
(a)in paragraph (1) for “paragraphs (3) and (4)” there shall be substituted “paragraphs (3) to (5)”;
(b)after paragraph (4) there shall be inserted—
“(5) Notwithstanding paragraph (1)(b), regulations 4 and 5 shall apply to a person carrying on any of the following activities, that is to say the handling in or sale from any catering establishment or shop premises of any heat-treated cream or of any ice-cream; and for the purposes of this paragraph the expressions “catering establishment”, “cream”, “handling”, “heat-treated”, “ice-cream”, “sale” and “shop premises” have the same meaning as in the Dairy Products (Hygiene) Regulations (Northern Ireland) 1995(3).”.

These Regulations amend the Food Safety (General Food Hygiene) Regulations (Northern Ireland) 1995 (“the 1995 Regulations”) so that those Regulations apply to a person carrying on the handling in or sale from any catering establishment or shop premises of ice-cream or heat-treated cream. The 1995 Regulations implement Council Directive 93/43/EEC on the hygiene of foodstuffs (O.J. No. L175, 19.7.93, p. 1), except for the requirements of paragraphs 4 and 5 of Chapter IX of the Annex to that Directive (which relate to temperature controls) and for the requirements in that Directive which relate to imports which are likely to pose a serious risk to human health and which come from countries that are not part of the European Community. They also implement the provisions of Council Directive 80/778/EEC relating to the quality of water intended for human consumption (O.J. No. L229, 30.8.90, p. 11) which relates to the use of water for food production purposes.
