59. Sections 46(1)(a)(ii)(1) and 48(2A)(a)(i) of the Act(2) shall be construed as if the reference to a person entitled to receive a guaranteed minimum pension included a reference to a person so entitled by virtue of being the widower of an earner only in the case where the earner and the widower were both over pensionable age when the earner died.
Section 46(1)(a)(ii) is amended by paragraph 37 of Schedule 3 to the Pensions (Northern Ireland) Order 1995
Section 48(2A) is substituted by paragraph 39 of the Schedule 3 to the Pensions (Northern Ireland) Order 1995
