13. In regulation 1(2) of the Personal and Occupational Pension Schemes (Pensions Ombudsman) Regulations (Northern Ireland) 1997(1) for the definition of “administrator” there shall be substituted the following definition—
““administrator”—
in relation to an occupational pension scheme, means any person concerned with the administration of the scheme, other than a person responsible for the management of the scheme (as defined in section 142(3) of the Act(2) for the purposes of Part X of the Act), and
in relation to a personal pension scheme, means any person concerned with the administration of the scheme, other than—
a person responsible for the management of the scheme (as defined in section 142(3A) of the Act for the purposes of Part X of that Act); or
a person who is or has been the employer of any member who is or has been an employed earner;”.
Section 142 was amended by Article 153(2) and (3) of the Pensions (Northern Ireland) Order 1995
