The Department of Health and Social Services for Northern Ireland, in exercise of the powers conferred on it by sections 2(2), 177(2) to (4) and 178(1) of the Pension Schemes (Northern Ireland) Act 1993(1) and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Register of Occupational and Personal Pension Schemes (Amendment) Regulations (Northern Ireland) 1997 and shall come into operation on 29th June 1997.

(2) The Interpretation Act (Northern Ireland) 1954(2) shall apply to these Regulations as it applies to a Measure of the Assembly.

Amendment of the Register of Occupational and Personal Pension Schemes Regulations

2.—(1) The Register of Occupational and Personal Pension Schemes Regulations (Northern Ireland) 1997(3) shall be amended in accordance with paragraphs (2) to (4).

(2) In regulation 1 for paragraph (5) there shall be substituted the following paragraph—

(5) Notwithstanding section 24(1) of the Interpretation Act (Northern Ireland) 1954, a notice under regulation 2(2)(b) or 6(3) may be sent by ordinary post to the trustees..

(3) In regulation 2(2)(b) (information required in respect of registrable schemes) for the words from “receipt of a written notice” to “these Regulations,” there shall be substituted “Registrar's, on or after the date of coming into operation of these Regulations, sending by post to the trustees a written notice requiring that information to be furnished,”.

(4) In regulation 6(3) (transitional provisions) for “by 30th June 1997” there shall be substituted “within 3 months of the Registrar’s sending by post to the trustees a written notice requiring that information to be furnished”.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Register of Occupational and Personal Pension Schemes Regulations (Northern Ireland) 1997 (“the principal Regulations”).

Regulation 1 relates to citation, commencement and interpretation.

Regulation 2(3) amends regulation 2(2)(b) of the principal regulations so that incidental information required by the Registrar is to be provided by the trustees within 3 months of the Registrar’s sending to them by post a written notice requesting the information rather than within 3 months of receipt of such notice.

Regulation 2(4) amends regulation 6(3) of the principal Regulations. Where a scheme became registrable before 1st April 1997 the trustees shall provide the Registrar with the information mentioned in regulation 6(3) of the principal Regulations within 3 months of a request for the information from the Registrar.

Regulation 2(2) makes a consequential amendment to regulation 1(5) of the principal Regulations.

Section 178(1) of the Pension Schemes (Northern Ireland) Act 1993, one of the enabling provisions under which these regulations are made, was amended by Parts III and IV of Schedule 5 to the Pensions (Northern Ireland) Order 1995. The Pensions (1995 Order) (Commencement No. 8) Order (Northern Ireland) 1997 (S.R. 1997 No. 192 (C. 10)) provides for the coming into operation of those Parts of Schedule 5, in so far as they affect section 178(1), on 6th April 1997.
