Saving and transitional provision for designs approved under earlier international regulations or under previous Regulations
9.—(1) Subject to paragraphs (2) to (4), notwithstanding the provisions of regulations 6 to 8 of these Regulations or regulation 27 of the Carriage of Dangerous Goods by Rail Regulations (Northern Ireland) 1998(), any packaging, the construction of which was commenced before the date of the coming into operation of these Regulations and which is manufactured to a design approved by a competent authority under the Regulations for the Safe Transport of Radioactive Material 1973 Edition(), the 1973 (as amended) Edition() of those Regulations or the Carriage of Dangerous Goods by Rail Regulations (Northern Ireland) 1998 may continue to be used for the carriage of radioactive material.
(2) The use of any packaging falling within paragraph (1) shall require multilateral approval.
(3) Before use, any packaging falling within paragraph (1) shall be legibly and durably marked with a serial number assigned in accordance with paragraph 8 of Schedule 13.
(4) Paragraph (1) shall not apply where changes which have been made in the design of the packaging or in the nature or quantity of the authorised radioactive contents are likely to affect safety.
