A person contravening any provision of these Regulations shall be guilty of an offence.

Any person guilty of an offence under these Regulations shall be liable—

a

on conviction on indictment, to a fine or to imprisonment for a term not exceeding two years or to both;

b

on summary conviction to a fine not exceeding the statutory maximum or to imprisonment for a term not exceeding three months or to both.

Article 19 of the Food Safety (Northern Ireland) Order 199111 shall apply to the commission by any person of an offence under these Regulations, and Article 20(1), (5) and (6) of that Order shall apply in any proceedings for an offence under these Regulations, as if, in all of those provisions, the references to “any of the preceding provisions of this Part” were references to these Regulations.
