The Department of the Environment, in exercise of the powers conferred on it by Article 7(3) of the Local Government (Miscellaneous Provisions) (Northern Ireland) Order 19921 and of all other powers enabling it in that behalf, hereby makes the following regulations:

Citation and commencement1

These regulations may be cited as the Local Government (Competition in Functional Work) (Amendment) Regulations (Northern Ireland) 1998 and shall come into operation on 3rd August 1998.

Amendment to provisions relating to specified dates2

In Column 2 of the Schedule to the Local Government (Competition in Functional Work) Regulations (Northern Ireland) 19952, for “1st November 1998”, wherever it appears, there shall be substituted “1st November 1999”.

The Local Government (Competition in Functional Work) Regulations (Northern Ireland) 1995 describe for the purposes of Article 7(3) of the Local Government (Miscellaneous Provisions) (Northern Ireland) Order 1992 (“the Order”) the nature of the functional work (as defined in Article 3(1)) which the councils specified in the schedule may not carry out on or after the dates specified in the schedule unless certain conditions (designed to ensure competition) are fulfilled (regulation 2).

These Regulations extend the date specified for the district council services of Managing sports and leisure facilities and Construction and maintenance work from 1st November 1998 to 1st November 1999.
