Food Protection (Emergency Prohibitions) (Amendment) Order (Northern Ireland) 1998

The Department of Agriculture, in exercise of the powers conferred on it by sections 1(1) and 24(3) of the Food and Environment Protection Act 1985(1) and of every other power enabling it in that behalf, being of the opinion in accordance with section 1(1) of that Act that there exist or may exist circumstances which are likely to create a hazard to human health through human consumption of food and that in consequence food which is or may be in the future derived from sheep in the areas described in the Schedule to the Food Protection (Emergency Prohibitions) Order (Northern Ireland) 1991(2), is, or may be, or may become, unsuitable for human consumption, hereby makes the following Order:—

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Food Protection (Emergency Prohibitions) (Amendment) Order (Northern Ireland) 1998 and shall come into operation on 6th March 1998.

(2) The Interpretation Act (Northern Ireland) 1954(3) shall apply to this Order as it applies to a Measure of the Northern Ireland Assembly.

Amendment

2.  The Food Protection (Emergency Prohibitions) Order (Northern Ireland) 1991 shall cease to have effect in relation to the area in Glenwherry, County Antrim described in the Schedule to the Food Protection (Emergency Prohibitions) Order (Northern Ireland) 1991 and accordingly in that Schedule the entry relating to this area is hereby revoked.

Explanatory Note

(This note is not part of the Order.)

This Order further amends the Food Protection (Emergency Prohibitions) Order (Northern Ireland) 1991 (the ‘principal order') which contains emergency prohibitions on various activities in order to prevent human consumption of food which is derived from sheep in the designated areas in Northern Ireland and which has been or may have been rendered unsuitable for human consumption in consequence of the elevated levels of radioactivity found in those areas following the escape of radioactive substances from a nuclear reactor situated at Chernobyl in the Ukraine.

The effect of this Order is that Glenwherry, County Antrim is no longer a designated area, and that the restrictions set out in the principal order no longer apply to it.
