Notice of appeal10.

(1)

A person who wishes to appeal to the Department under Article 15 or 22(5) of the Order shall give to the Department written notice of the appeal together with the documents specified in paragraph (2) and shall at the same time send to the enforcing authority a copy of that notice together with the documents specified in paragraph (2)(a) and (f).

(2)

The documents mentioned in paragraph (1) are—

(a)

a statement of the grounds of appeal;

(b)

a copy of any relevant application;

(c)

a copy of any relevant authorisation;

(d)

a copy of any relevant correspondence between the appellant and the enforcing authority;

(e)

a copy of any decision or notice which is the subject-matter of the appeal;

(f)

a statement indicating whether the appellant wishes the appeal to be in the form of a hearing or to be disposed of on the basis of written representations.

(3)

If the appellant wishes to withdraw an appeal he shall do so by notifying the Department in writing and shall send a copy of that notification to the enforcing authority.
