Coming into operation

The Attorney General, in exercise of the powers conferred on him by Article 4(7) of the Criminal Justice (Serious Fraud) (Northern Ireland) Order 19881, hereby makes the following regulations:—

Citation and commencement1

These regulations may be cited as the Criminal Justice (Serious Fraud) (Northern Ireland) Order 1988 (Notice of Transfer) (Amendment) Regulations 1998 and shall come into operation on 14th February 1998.

Interpretation2

In these regulations—

  • “criminal investigation” has the meaning specified in section 1(4) of the 1996 Act;

  • “the principal regulations” means the Criminal Justice (Serious Fraud) (Northern Ireland) Order 1988 (Notice of Transfer) Regulations 19892;

  • “the 1996 Act” means the Criminal Procedure and Investigations Act 19963.

Amendment of the principal regulations3

Paragraph 8 of Form 2 in the Schedule to the principal regulations shall cease to have effect in relation to alleged offences into which no criminal investigation has begun before the commencement of Part I of the 1996 Act.

These regulations revoke paragraph 8 of Form 2 in the Schedule to the Criminal Justice (Serious Fraud) (Northern Ireland) Order 1988 (Notice of Transfer) Regulations 1989 which informed the accused of the requirement to give notice of particulars of an alibi in accordance with section 1 of the Evidence of Alibi Act (Northern Ireland) 1972. By virtue of regulation 1, the regulations come into operation on 14th February 1998 in relation to alleged offences into which no criminal investigation has begun before 1st January 1998, the date of commencement of Part I of the Criminal Procedure and Investigations Act 1996.
