Where the parties to a construction contract fail to provide a final date for payment in relation to any sum which becomes due under a construction contract, this paragraph shall apply.

The final date for the making of any payment of a kind mentioned in paragraphs 2, 5, 6 or 7, shall be 17 days from the date that payment becomes due.
