SOCIAL SECURITY

The Social Security (Therapeutic Earnings Limits) (Amendment) Regulations (Northern Ireland) 2000

The Department for Social Development, in exercise of the powers conferred by sections 30E(1), 167D and 171(2) to (4) of, and paragraph 2(3) of Schedule 7 to, the Social Security Contributions and Benefits (Northern Ireland) Act 1992(1), and now vested in it(2), and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Social Security (Therapeutic Earnings Limits) (Amendment) Regulations (Northern Ireland) 2000 and shall come into operation on 2nd October 2000.

Amendment of the Social Security (General Benefit) Regulations

2.  In regulation 14 of the Social Security (General Benefit) Regulations (Northern Ireland) 1984(3) (earnings level for the purposes of unemployability supplement) for “£3,042·00” there shall be substituted “£3,094·00”.

Amendment of the Social Security (Incapacity Benefit) Regulations

3.  In regulation 7 of the Social Security (Incapacity Benefit) Regulations (Northern Ireland) 1994(4) (limit of earnings from councillor’s allowance) for “£58·50” there shall be substituted “£59·50”.

Amendment of the Social Security (Incapacity for Work) (General) Regulations

4.  In regulation 17(2)(a) of the Social Security (Incapacity for Work) (General) Regulations (Northern Ireland) 1995(5) (exempt work) for “£58·50” there shall be substituted “£59·50”.

Revocations

5.  Regulations 4 and 5 of the Social Security Benefits Up-rating Regulations (Northern Ireland) 2000(6) and the Social Security Benefits Up-rating and Miscellaneous Increases Regulations (Northern Ireland) 2000(7) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations further amend the Social Security (General Benefit) Regulations (Northern Ireland) 1984, the Social Security (Incapacity Benefit) Regulations (Northern Ireland) 1994 and the Social Security (Incapacity for Work) (General) Regulations (Northern Ireland) 1995 to take into account the increase in the national minimum wage.

Regulation 2 increases the annual unemployability supplement earnings level from £3,042·00 to £3,094·00.

Regulation 3 increases the weekly earnings limit for a councillor’s allowance in relation to incapacity benefit from £58·50 to £59·50.

Regulation 4 increases the weekly incapacity for work therapeutic earnings limit from £58·50 to £59·50.

Regulation 5 contains consequential revocations.

These Regulations correspond to provision contained in Regulations made by the Secretary of State for Social Security in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992 (c. 8), are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.

These Regulations do not impose a charge on business.
