The Department of the Environment, in exercise of the powers conferred on it by Articles 4(8) and 16(3) of the Local Government (Miscellaneous Provisions) (Northern Ireland) Order 19921 and of all other powers enabling it in that behalf, hereby makes the following Order:

Title, commencement and interpretation1

This Order may be cited as the Local Government (Defined Activities) (Exemptions) Order (Northern Ireland) 2000 and shall come into operation on 1st April 2000.

In this Order “the exemption end date for a council” shall be construed in accordance with Article 3.

Activities not to be treated as defined activities2

Where the activity specifed in column 2 of the Schedule is carried out by a council specified in column 1 of the Schedule on or before the exemption end date for that council, that activity shall not be treated as a defined activity on or before the exemption end date for that council.

Provision as to end of exemption3

In respect of each council specified in column 1 of the Schedule, the exemption end date for that council is, in respect of maintenance of ground, the date specified opposite that council in column 2 of that Schedule.

This Order provides that the maintenance of ground shall not be treated as a defined activity on or before 31st March 2002, where that activity is carried out by council specified in column 1 of the Schedule on or before that date.
