SEA FISHERIES

The Department of Agriculture and Rural Development, in exercise of the powers conferred on it by section 124(1), (2) and (2A) of the Fisheries Act (Northern Ireland) 1966(1) and of all other powers enabling it in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Strangford Lough (Prohibition of Fishing for Shellfish) Regulations (Northern Ireland) 2001 and shall come into force on 23rd November 2001.
2. In this Order—
“Strangford Lough” means the sea area to the north west of an imaginary straight line drawn from Killard Point to Ballyquintin Point, Co Down
“the Act” means the Fisheries Act (Northern Ireland) 1966.
3. A person shall not fish for shellfish from or by means of any mechanically propelled vehicle in Northern Ireland inshore waters lying within the area of Strangford Lough except under and in accordance with the conditions of—
(a)a fish culture licence granted under section 11 of the Act; or
(b)a permit granted under section 14(1) of the Act.
4. The prohibition contained in regulation 3 shall not apply to the use of a fishing boat.

These Regulations prohibit the fishing for shellfish from the Northern Ireland inshore waters of Strangford Lough using any mechanically propelled vehicle except a fishing boat.
This prohibition does not extend to any person who is operating under the authority of a fish culture licence granted under section 11 of the Act or under the authority of a permit granted under section 14(1) of the Act.
A person who commits an offence under section 124 of the Act shall be liable on summary conviction to a fine not exceeding level 5 on the standard scale (£5,000).
