BETTING, GAMING AND LOTTERIES

Gaming (Variation of Monetary Limits) Order (Northern Ireland) 2001

Coming into operation in accordance with Article 1(1)

The Department for Social Development, in exercise of the powers conferred on it by Articles 75(2), 76(5), 77(4), 126(15) and 128(3) of the Betting, Gaming, Lotteries and Amusements (Northern Ireland) Order 1985(1) and now vested in it(2) and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Gaming (Variation of Monetary Limits) Order (Northern Ireland) 2001 and shall come into operation on the day after the day on which it is affirmed by resolution of the Assembly.

(2) In this Order “the 1985 Order” means the Betting, Gaming, Lotteries and Amusements (Northern Ireland) Order 1985.

Maximum amount of weekly winnings in games of bingo played simultaneously on different bingo club premises

2.  For the purposes of Article 75(2)(ii) of the 1985 Order instead of £30,000(3) the amount £55,000 is hereby specified.

Maximum amount by which weekly winnings on bingo club premises may exceed the stakes hazarded

3.  For the purposes of Article 76(5) of the 1985 Order instead of £5,500(4) the amount £10,000 is hereby specified.

Conditions governing gaming for prizes on bingo club premises

4.  In Article 77(1) of the 1985 Order—

(a)in sub-paragraph (a) for “£0·30” there shall be substituted “£0·50”;

(b)in sub-paragraphs (b) and (e) for “£50”(5) there shall be substituted “£120”;

(c)in sub-paragraph (c) for “£5”(6) there shall be substituted “£15”.

Maximum amounts permitted in gaming at entertainments not held for private gain

5.—(1) In Article 126 of the 1985 Order—

(a)in paragraph (3) for “£3”(7) there shall be substituted “£4”;

(b)in paragraph (4) for “£300”(8) there shall be substituted “£400”; and

(c)in paragraph (11)(b) for “£300”(9) and “£600”(e) there shall be substituted respectively “£400” and “£700”.

(2) Paragraph (1) shall have effect only in relation to entertainments held on or after the date on which this Order comes into operation.

Maximum daily charges for play at certain clubs

6.—(1) In Article 128(2) of the 1985 Order for “£0·50”(10) there shall be substituted “£0·60”.

(2) For the purposes of Article 128(2) of the 1985 Order, in the case of gaming which consists exclusively of playing bridge or whist, or bridge and whist, and which takes place on a day on which the premises used therefor are not used for any other gaming, or for any other gaming except gaming by means of a gaming machine, instead of £6(11) the sum £15 is hereby specified.

Revocations

7.  The following are hereby revoked—

(a)Articles 2 and 3 of the Gaming (Variation of Monetary Limits) Order (Northern Ireland) 1999(12);

(b)Article 2 of the Gaming (Variation of Monetary Limits) Order (Northern Ireland) 1998(13);

(c)Articles 7 and 8 of the Betting, Gaming, Lotteries and Amusements with Prizes (Variation of Fees and Monetary Limits) Order (Northern Ireland) 1995(14);

(d)the Betting and Gaming (Fees and Variation of Monetary Limits) Order (Northern Ireland) 1987(15).

Explanatory Note

(This note is not part of the Order.)

This Order—

(a)increases the maximum permitted aggregate amount of winnings in respect of games of bingo played in 1 week simultaneously on different bingo club premises from £30,000 to £55,000;

(b)increases the maximum amount by which weekly winnings on bingo club premises may exceed the stakes hazarded from £5,500 to £10,000;

(c)increases, in gaming for prizes on bingo club premises:

(i)the maximum amount paid by any 1 person for any 1 chance to win a prize from £0·30 to £0·50;

(ii)in any 1 determination of winners, the maximum permitted aggregate amount taken by way of the sale of chances from £50 to £120 and the maximum permitted aggregate amount or value of prizes from £50 to £120;

(iii)the maximum money prize which can be distributed or offered from £5 to £15;

(d)increases, in gaming at entertainments not held for private gain:

(i)the maximum payment to be made by each player in respect of all the games at 1 entertainment from £3 to £4 and the total value of prizes and awards in respect of those games from £300 to £400;

(ii)the maximum payment to be made by each player in respect of all the games at 2 or more entertainments promoted on the same premises by the same persons on the same day from £3 to £4 and the total value of all the prizes and awards in respect of those games from £300 to £400;

(iii)the total value of prizes and awards in the final entertainment of a series of entertainments from £600 to £700;

(e)increases:

(i)the maximum daily charge for gaming in certain clubs from £0·50 to £0·60;

(ii)the maximum daily charge for gaming in such clubs from £6 to £15 when only bridge and/or whist are/is played.
