Foyle Area and Carlingford Area (Licensing of Fishing Engines) (Amendment) Regulations 2003

Coming into operation

The Foyle, Carlingford and Irish Lights Commission, in exercise of its powers under section 13(1) (amended by section 34(3) of the British-Irish Agreement Act 19991 and section 5(1) of the British-Irish Agreement (Amendment) Act 2002) and 13(2) of the Foyle Fisheries Act 19521 which stand transferred to it under section 34(1) of the British-Irish Agreement Act 1999, and in exercise of the powers conferred by section 13(1) and (2) of the Foyle Fisheries Act (Northern Ireland) 19522 and now vested in it3 and of every other power enabling it in that behalf, with the approval of the Government of Ireland and the Government of the United Kingdom of Great Britain and Northern Ireland, under the agreement made between those Governments on 19th November 20024 and section 5(1) of the British-Irish Agreement (Amendment) Act 20001, hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Foyle Area and Carlingford Area (Licensing of Fishing Engines) (Amendment) Regulations 2003 and shall come into operation on 1st March 2003.

Amendment of the Foyle and Carlingford Area (Licensing of Fishing Engines) Regulations 20012

The Foyle and Carlingford Area (Licensing of Fishing Engines) Regulations 20015 shall be amended as provided in regulations 3 to 5.

Interpretation3

In regulation 2 (interpretation) there shall be added at the appropriate alphabetical places the following definitions–

  • “coarse fishing rod licence” means a fishing licence issued by the Commission for one rod and line to fish for, take and kill eels and coarse fish;

  • “game fishing rod licence” means a fishing licence issued by the Commission for one rod and line to fish for, take and kill salmonids, eels and coarse fish;

  • “salmonids” means a fish of the family Salmonidae, including salmon, sea trout, rainbow trout and brown trout

Licensing of fishing engines4

In regulation 3(1) for the words “salmon, trout, rainbow trout” where they twice occur there shall be substituted the words “salmonoids, eels”.

These Regulations amend the Foyle and Carlingford Area (Licensing of Fishing Engines) Regulations 2001.

Apart from minor and drafting amendments they–

a

introduce a prohibition on fishing for eels except under licence;

b

alter the fee for a season game fishing rod and line licence from £21·00 or 33·00 to £21·50 and 32·00 respectively;

c

reduce the fee for a fourteen day game fishing rod and line licence from £15·50 or 24·00 to £10·50 and 15·50 respectively;

d

replace the one day game fishing rod and line licence with a three day game fishing and rod and line licence;

e

reduce the fee for a season game fishing rod and line licence for a person under the age of eighteen from £10·00 or 16·00 to £2·00 and 3·00 respectively;

f

reduce the concessionary season game fishing rod and line licence for a person holding a season game fishing rod and line licence issued by another authority or body on the island of Ireland from £17·00 or 27·00 to £1·00 and 1·50 respectively; and

g

reduce the fee for a season coarse fishing rod and line licence for a person under the age of eighteen from £4·00 or 6·00 to £2·00 and 3·00 respectively.
