Where a developer proposes to change or extend any harbour works which are the subject of a consent under regulation 11(2), or regulation 11(2) as modified by regulation 12, he shall make an application to the appropriate Department to vary that consent.

The appropriate Department shall determine whether, taking into account the selection criteria, the proposed change or extension constitutes a relevant project.

Where the appropriate Department determines that, taking into account the selection criteria, the proposed change or extension constitutes a relevant project, regulations 6(6), (7), (9), (10), 7, 8, 10, 11, 14 and 15 shall apply in relation to the application as they apply in relation to an application referred to in regulation 6(1).
