Eel Fishing (Licence Duties) Regulations (Northern Ireland) 2004

The Department of Culture, Arts and Leisure(1), in exercise of the powers conferred by sections 15(1) and 19(1) of the Fisheries Act (Northern Ireland) 1966(2) and now exercisable by it(3), and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Eel Fishing (Licence Duties) Regulations (Northern Ireland) 2004 and shall come into operation on 5th April 2004.

Licence Duties

2.  There shall be payable to the Fisheries Conservancy Board for Northern Ireland by way of licence duties in respect of licences for the use of fishing engines for the taking of eels referred to in column 1 of the Schedule the amounts respectively specified in column 2 of the Schedule.

Revocation

3.  The Eel Fishing (Licence Duties) Regulations (Northern Ireland) 2000(4) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the licence duties payable to the Fisheries Conservancy Board for Northern Ireland in respect of licences for the use of fishing engines for the taking of eels. The new duties, and the size of the increases or decreases, where applicable, are set out below.

The Regulations no longer prescribe duties in respect of licences for the following fishing engines which will not now be issued by the Fisheries Conservancy Board:

(a)the existing eel weir at Rademon;

(b)the existing eel weir at Drumnaconagher, Crossgar;

(c)fixed wing nets, used in the River Erne in the County of Fermanagh between Roscor Viaduct and a point 800 metres downstream of Roscor Viaduct, or in the River Quoile in the County of Down between the floodgates at the Old Quoile Bridge and the tidal barrier at Hare Island, and having a leader and a wing or wings each not exceeding 23 metres in length, for each batch of 5 or less;

(d)fixed wing nets used in that part of Lower Lough Erne in the County of Fermanagh lying between Roscor Viaduct and an imaginary line running directly from North to South and passing through the Western tip of Ferny Island in the Parish of Belleek, Barony of Lurg and having a leader and wing or wings, each not exceeding 230 metres in length, for each batch of 10 or less.
