The Secretary of State shall determine the circumstances in which and the conditions subject to which uniform and equipment is to be issued by the Chief Constable to a member, and in making such a determination the Secretary of State may confer on the Chief Constable discretion to specify the type of uniform and equipment to be issued.

A determination under paragraph (1) may make different provision for different cases and circumstances.
