The Department of the Environment, in exercise of the powers conferred upon it by Article 65(1) and (2) of the Road Traffic (Northern Ireland) Order 1981(1) and of every other power enabling it in that behalf, hereby makes the following By-Laws:

Citation and commencement

1.  These By-Laws may be cited as the Motor Hackney Carriages (Belfast) (Amendment) By-Laws (Northern Ireland) 2004 and shall come into operation on 1st December 2004.

By-Laws amended

2.  For by-law 26(1) of the By-Laws relating to Motor Hackney Carriages standing or plying for hire made by the Council of the County Borough of Belfast on 4th June 1951(2) there shall be substituted –

26.(1) The fares payable for the hire of a Motor Hackney Carriage within the prescribed limits shall be –

(b)for each minute or part of a minute during which the taxi is kept waiting by the hirer for the rates described in the Table in sub-paragraph (a) –

In assessing additional fares every child under the age of 6 years and/or one child over 6 years and under 12 years shall be disregarded. Two children between the ages of 6 years and 12 years shall be counted as one passenger..

Revocation

3.  The Motor Hackney Carriages (Belfast) (Amendment) By-Laws (Northern Ireland) 2001(3) are hereby revoked.

Explanatory Note

(This note is not part of the By-Laws.)

These By-Laws amend the Motor Hackney Carriages (Belfast) By-Laws made by the Council of the County Borough of Belfast on 4th June 1951 by revising the rates of fare to be charged.

The fare structure is now made up of 4 different rates which apply at different times of the day and at Christmas and New Year holidays.

The fare charged shall be the sum total of the charges for the individual stages of the journey, which are calculated on distance or time, and such other additional charges as may apply.

The Motor Hackney Carriages (Belfast) (Amendment) By-Laws (Northern Ireland) 2001 are revoked as a consequence of these By-Laws.
