The Youth Justice and Criminal Evidence Act 1999 (Commencement Order No. 1) (Northern Ireland) Order 2004

In exercise of the powers conferred upon him by sections 64(4) and 68(3) of the Youth Justice and Criminal Evidence Act 1999(1), the Secretary of State, hereby makes the following Order:

Citation

1.  This Order may be cited as the Youth Justice and Criminal Evidence Act 1999 (Commencement Order No. 1) (Northern Ireland) Order 2004.

Appointed day

2.  8th November 2004 is the day appointed for the coming into force of the following provisions of Youth Justice and Criminal Evidence Act 1999:

(a)section 46 (power to restrict reports about certain adult witnesses in criminal proceedings);

(b)section 47 (restrictions on reporting directions under Chapter I or II)

(c)section 48(c), and (e) and paragraphs 4 to 15 of Schedule 2 (amendments relating to other reporting restrictions);

(d)sections 49, 50, 51 and 52 in so far as they have effect for the purposes of sections 46 and 47 of that Act;

(e)in Schedule 6, the entries relating to –

(i)the Sexual Offences (Northern Ireland) Order 1978(2);

(ii)the Criminal Justice (Northern Ireland) Order 1994(3), and section 67(3) in so far as it relates to those entries;

(iii)Sexual Offences (Amendment) Act 1976(4);

(iv)Sexual Offences (Amendment) Act 1992(5);

(f)paragraph 6 of Schedule 7, in so far as it relates to section 46, and section 67(4) in so far as it relates to paragraph 6.

Explanatory Note

(This note is not part of the Order.)

This Order brings into force on 8th November 2004 section 46 of the Youth Justice and Criminal Evidence Act 1999 relating to the power of the courts to restrict reports about certain adult witnesses in criminal proceedings. It also brings into force sections 48, 49, 50, 51 and 52 in so far as those provisions are relevant to sections 46 and 47.

This Order extends to Northern Ireland only.
