Coming into operation

The Department of the Environment, in exercise of the powers conferred upon it by Article 4 of the Environment (Northern Ireland) Order 20021, and of all other powers enabling it in that behalf and, in accordance with Article 4(4) of that Order, having consulted district councils and such bodies or persons appearing to it to be representative of the interests of district councils as it considers appropriate, such bodies or persons appearing to it to be representative of the interests of industry, agriculture and business as it considers appropriate and such other bodies or persons as it considers appropriate, hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Pollution Prevention and Control (Amendment) Regulations (Northern Ireland) 2004 and shall come into operation on 31st December 2004.

Amendment to the Industrial Pollution Control (Prescribed Processes and Substances) Regulations (Northern Ireland) 19982

The Industrial Pollution Control (Prescribed Processes and Substances) Regulations (Northern Ireland) 19982 shall be amended as follows.

In paragraph (a) of Part C of Section 1.4 of Chapter 1 of Schedule 1 (Petroleum Processes), for the figure “100m3” substitute the figure “500m3”.

Amendment to the Pollution Prevention and Control Regulations (Northern Ireland) 20033

The Pollution Prevention and Control Regulations (Northern Ireland) 20033 shall be amended as follows.

In paragraph (b) of Part C of Section 1.2 of Part 1 of Chapter 1 of Schedule 1 (Gasification, Liquefaction and Refining Activities), for the figure “100m3” substitute the figure “500m3”.

These Regulations amend the Pollution Prevention and Control Regulations (Northern Ireland) 2003 and the Industrial Pollution Control (Prescribed Processes and Substances) Regulations (Northern Ireland) 1998 to take account in Northern Ireland of the derogation of the United Kingdom from European Parliament and Council Directive 94/63/EC of 20th December 1994 on the control of volatile organic compound (VOC) emissions resulting from the storage of petrol and its distribution from terminals to service stations.
