The Department of Health, Social Services and Public Safety(1), in exercise of the powers conferred on it by section 3(1)(b) of the Health and Personal Social Services Act (Northern Ireland) 2001(2) and of all other powers enabling it in that behalf, and having consulted the Northern Ireland Social Care Council(3), hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Northern Ireland Social Care Council (Description of social care workers) Order (Northern Ireland) 2004 and shall come into operation on 1st April 2004.

(2) In this Order –

(a)“the Act” means the Health and Personal Social Services Act (Northern Ireland) 2001; and

(b)“student social care worker” means a person participating in a course approved by the Council under section 10 of the Act for persons wishing to become social workers.

Description of social care workers

2.  A person who is a student social care worker is hereby specified as a description of social care worker for the purposes of section 3(1)(b) of the Act.

Explanatory Note

(This note is not part of the Order.)

This Order is made under section 3(1)(b) of the Health and Personal Social Services Act (Northern Ireland) 2001 (“the Act”). Under section 3 of the Act the Northern Ireland Social Care Council (“the Council”) must maintain a register of social workers and of social care workers of any other description specified by Order made by the Department of Health, Social Services and Public Safety. This Order specifies students, participating in a course approved by the Council for persons wishing to become social workers, as a description of social care worker for the purposes of section 3 of the Act.
