The Social Security (Claims and Payments) (Amendment No. 2) Regulations (Northern Ireland) 2005

Explanatory Note

(This note is not part of the Regulations.)

Regulation 2 of these Regulations amends the Social Security (Claims and Payments) Regulations (Northern Ireland) 1987 to –

  • provide an extended time for claiming bereavement benefit, or an increase in certain benefits in respect of an adult or child dependant, where death is difficult to establish (paragraph (2)); and

  • omit an obsolete definition of “income support” and increase from £18·10 to £18·80 the amount allowed for personal expenses where a person is in accommodation for which part of his benefit is paid direct to the person to whom charges in respect of that accommodation are payable (paragraph (3)).

Regulation 3 makes consequential revocations.

These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.

These Regulations do not impose a charge on business.
