Education (Supplement to the Special Educational Needs Code of Practice) (Appointed Day) (Northern Ireland) Order 2005

The Department of Education, in exercise of the powers conferred on it by Article 5(3) of the Education (Northern Ireland) Order 1996(1) and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Education (Supplement to the Special Educational Needs Code of Practice) (Appointed Day) (Northern Ireland) Order 2005 and shall come into operation on the 1st September 2005.

Appointed day

2.  1st September 2005 is hereby appointed as the day on which the Supplement to the Code of Practice on the Identification and Assessment of Special Educational Needs issued pursuant to Article 5(3) of the Education (Northern Ireland) Order 1996 shall come into operation.

Explanatory Note

(This note is not part of the Order)

This Order appoints the 1st September 2005 as the day on which the Supplement to the Code of Practice on the Identification and Assessment of Special Educational Needs (the Supplement) shall come into operation.

This Supplement (pursuant to Article 4 of the Education (Northern Ireland) Order 1996 (“the 1996 Order”)) gives practical guidance in respect of the discharge by Education and Library Boards and the Boards of Governors of grant-aided schools of their functions under Part II of the 1996 Order as amended by the Special Educational Needs and Disability (Northern Ireland) Order 2005.

The Supplement should be read in conjunction with the Code of Practice on the Identification and Assessment of Special Educational Needs (the Code of Practice). Schools, Boards and Boards of Governors and, on appeal, the Special Educational Needs and Disability Tribunal (SENDIST) should have regard to the provisions of both the Code of Practice and the Supplement.
