The Department of Agriculture and Rural Development(1) being a Department designated(2) for the purposes of section 2(2) of the European Communities Act 1972(3) in relation to medicinal products and the common agricultural policy of the European Community, in exercise of the powers conferred on it by the said section 2(2), and of all other powers enabling it in that behalf, after carrying out the consultation required by Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety(4), hereby makes the following Regulations:

Citation and commencementN.I.

1.  These Regulations may be cited as the Animals and Animal Products (Examination for Residues and Maximum Residue Limits) (Amendment) Regulations (Northern Ireland) 2005 and shall come into operation on 14th November 2005.

InterpretationN.I.

2.  The Interpretation Act (Northern Ireland) 1954(5) shall apply to these Regulations as it applies to an Act of the Assembly.

Amendment of the Animals and Animal Products (Examination for Residues and Maximum Residue Limits) Regulations (Northern Ireland) 1998N.I.

3.—(1) The Animals and Animal Products (Examination for Residues and Maximum Residue Limits) Regulations (Northern Ireland) 1998(6) shall be amended in accordance with paragraph (2).

(2) In regulation 6 (prohibition of administration to animals of unlicensed substances or unlicensed products), paragraph (1), after the words “Annexes I, II or III of the Council Regulation”, there shall be inserted the following “, as read with Commission Decision 2000/68/EC(7),”.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Animals and Animal Products (Examination for Residues and Maximum Residue Limits) Regulations (Northern Ireland) 1998 (“the 1998 Regulations”).

The amendment reflects EC law in the area of horse passports, namely, Commission Decision 2000/68/EC of 22nd December 1999 amending Commission Decision 93/623/EEC and establishing the identification of equidae for breeding and production, insofar as it calls for qualification of the prohibition in the 1998 Regulations against administration to food producing animals of veterinary medicinal products containing substances not listed in Annexes I, II or III to Council Regulation (EEC) No. 2377/90 of 26th June 1990 laying down a Community procedure for the establishment of maximum residue limits of veterinary medicinal products in foodstuffs of animal origin (O.J. No. L224, 18.8.90, p. 1).
