The Department of the Environment, in exercise of the powers conferred upon it by Article 4 of the Environment (Northern Ireland) Order 2002(1), and of all other powers enabling it in that behalf and, in accordance with Article 4(4) of that Order, having consulted district councils and such bodies or persons appearing to it to be representative of the interests of district councils as it considers appropriate, such bodies or persons appearing to it to be representative of the interests of industry, agriculture and business as it considers appropriate and such other bodies or persons as it considers appropriate, hereby makes the following Regulations:

Citation and commencementN.I.

1.  These Regulations may be cited as the Pollution Prevention and Control (Amendment) (No. 3) Regulations (Northern Ireland) 2005 and shall come into operation on 1st November 2005.

Amendment to the Pollution Prevention and Control Regulations (Northern Ireland) 2003N.I.

2.—(1) The Pollution Prevention and Control Regulations (Northern Ireland) 2003(2) shall be amended as follows.

(2) For the definition of “vehicle refinishing” in paragraph (2) of Section 7 (SED Activities) of Part 1 of Schedule 1 (Activities, Installations and Mobile Plant) to the 2003 Regulations substitute the following:

“vehicle refinishing” means any industrial or commercial coating activity and associated degreasing activities performing—

(i)

the original coating of road vehicles as defined in Directive 70/156/EEC or part of them with refinishing-type materials, where this is carried out away from the original manufacturing line; or

(ii)

the coating of trailers (including semi-trailers) (category O);.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Pollution Prevention and Control Regulations (Northern Ireland) 2003.

They are made to take account of S.I. 2005 2773 “The VOCs in Paints, Varnishes and Vehicle Refinishing Products Regulations 2005” which implement Directive 2004/42/CE (“the VOCs in Paints Directive”) on the limitation of emissions of volatile organic compounds due to the use of organic solvents in certain paints, varnishes and vehicle refinishing products, and amending Directive 1999/13/EC (“the Solvent Emissions Directive”).

These Regulations delete from the scope of the 2003 Regulations one category of “vehicle refinishing” which has been removed by Article 13 of the VOCs in Paints Directive.
