Subject to paragraph (2), these Regulations shall not apply in relation to veterinary checks on movements of pets (other than equidae) accompanied by and under the responsibility of a natural person, where such movements are not the subject of a commercial transaction.

Where a person is accompanying and has under his responsibility more than 5 pets travelling together that –
a
are of a species listed in Annex I to Regulation (EC) No. 998/200310; and
b
come from a third country other than one listed in section 2 of part B of Annex II to Regulation (EC) No. 998/2003,
these Regulations shall apply to the veterinary checks on the movements of those animals, notwithstanding that their movement is not the subject of a commercial transaction.
