A controller found guilty of an offence under regulation 24 shall be liable:
a
on summary conviction, to a fine not exceeding level 5 on the standard scale together with a fine of an amount equal to one-tenth of that level for each day upon which the offence continues after the conviction; or
b
on conviction on indictment to a fine or to imprisonment for a term not exceeding 2 years or both.
