Determination of applications16.
(1)
Where an application is made to the Department for consent, it may, subject to the provisions of this regulation—
(a)
grant consent either subject only to the conditions required by regulation 22 or subject to such conditions and to further conditions as it sees fit; or
(b)
refuse consent.
(2)
The Department shall not determine an application for consent until after the expiry of the periods referred to in regulations 12 and 13 during which representations may be sent to the Department or where appropriate any period of consultation with an EEA State in accordance with regulation 15.
(3)
In determining an application for a consent in relation to a proposed project, the Department shall take into consideration the environmental information, any representations received by it and any other material consideration in relation to the project including in particular its assessment of the direct and indirect effects of the relevant project on the environmental factors specified in Schedule 4.
