The Department of Enterprise, Trade and Investment(1), in exercise of the powers conferred on it by Article 1 of the Companies (Audit, Investigations and Community Enterprise) (Northern Ireland) Order 2005(2) makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Companies (Audit, Investigations and Community Enterprise) (2005 Order) (Commencement No.1 and Transitional Provision) Order (Northern Ireland) 2006.

(2) In this Order —

“the 1986 Order” means the Companies (Northern Ireland) Order 1986(3); and

“the 2005 Order” means the Companies (Audit, Investigations and Community Enterprise) (Northern Ireland) Order 2005.

Appointed day

2.  The day appointed for the coming into operation of the provisions of the 2005 Order set out in the Schedule is 6th April 2006.

Transitional provision for Article 18 of the 2005 Order

3.  New Article 317A(4) shall have no effect in relation to provisions made before 19th July 2005 which are not void under old Article 318(5).

SCHEDULEPROVISIONS OF THE 2005 ORDER COMING INTO OPERATION ON 6th April 2006

  • Articles 18 to 19.

  • Article 24(2) in respect of the entry in Schedule 3 specified below relating to—

    • The 1986 Order, Articles 318(1) and (3).

Explanatory Note

(This note is not part of the Order)

This Order amends the law relating to the provision that may be made in respect of certain liabilities incurred by a company’s directors. Transitional provision prior to the date of Royal Assent is contained in Article 3.
