[F14.—(1) Subject to the following paragraphs and regulation 5, the fee payable to the Department by a person in each academic year in respect of a full-time higher education course shall [F2£1,785.]
(2) [F3Subject to paragraph (7) and regulation 5, where a person is ordinarily resident in England, Scotland, Wales, Gibraltar, the Channel Islands or the Isle of Man, the fee payable to the Department by that person in each academic year in respect of full-time higher education course shall be £9,250.]
(3) For the purposes of this regulation a person who is ordinarily resident in Northern Ireland as a result of having moved from England, Scotland, Wales, [F4 Gibraltar,] the Channel Islands or the Isle of Man for the purpose of undertaking a course is to be considered as ordinarily resident in England, Scotland, Wales, [F4 Gibraltar,] the Channel Islands or the Isle of Man as the case may be.
[F5(4) Subject to paragraph (5) and Regulation 5 the fee payable to the Department by an international student for each week of tuition in respect of a full time higher education course shall be £300.
(5) [F6International students are defined as persons undertaking a course of study at the College of Agriculture, Food and Rural Enterprise who would require a student visa to study in the UK for a course lasting 6 months or more.]
[F7(6)] The Department may charge a person a fee of such amount as it may determine in respect of any course of further education or part-time education undertaken by that person.]
[F8(7) Subject to regulation 5, where a person who is ordinarily resident in Gibraltar, the EU, Switzerland, Norway, Iceland or Liechtenstein, starts the first academic year of a full-time higher education course before 1st January 2021, the fee payable to the Department is set out in paragraph (1).
(8) Subject to regulation 5, where a person has obtained “pre-settled” or “settled” status through the EU Settlement Scheme, the fee payable to the Department is set out in paragraph (1).]]
