138.—(1) In determining whether a person who is an active member or a pensioner member of [F1this Section of] the Scheme is also a deferred member of it, the fact that the person is an active member or a pensioner member and the person's rights as such are to be disregarded.
(2) In determining whether a person is a pensioner member of [F1this Section of] the Scheme, the fact that the person is not entitled to payment of pension because of Chapter 8 is to be disregarded.
