Coming into operation
The Department of Agriculture and Rural Development, is designated 1for the purposes of section 2(2) of the European Communities Act 19722, in relation to the common agricultural policy of the European Community.
The Department of Agriculture and Rural Development, makes the following Regulations in exercise of the powers conferred upon it by section 2(2) of the European Communities Act 1972.
Citation and commencement1
These Regulations may be cited as the Zootechnical Standards (Amendment) Regulations (Northern Ireland) 2008 and shall come into operation on 22nd February 2008.
Interpretation2
The Interpretation Act (Northern Ireland) 19543 shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.
Amendment of the Zootechnical Standards Regulations (Northern Ireland) 19923

The Zootechnical Standards Regulations (Northern Ireland) 19924 are amended as follows.

In regulation 2 (1) (interpretation) before the definition of “Department” insert—
“Council Directive 87/328/EEC” means Council Directive 87/328/EEC5 on the acceptance for breeding purposes of pure-bred breeding animals of the bovine species, as amended by Council Directive 2005/24/EC6 with regard to the use of ova and embryos and storage centres for semen from pure-bred breeding animals of the bovine species;

After regulation 5 (acceptance for breeding purposes), add—
Collection, processing and storage of semen6

A recognised organisation shall ensure that semen referred to in Article 2 of Council Directive 87/328/EEC which is intended for intra-Community trade is collected, processed and stored in a collection centre, or if need be, stored at a storage centre, approved in accordance with Council Directive 88/407/EEC.

A recognised organisation which fails to comply with paragraph (1) may have its recognition withdrawn by the Department by notice in writing at any time.

In paragraph (1)“Council Directive 88/407/EEC” means Council Directive 88/407/EEC laying down the animal health requirements applicable to intra-Community trade in and imports of semen of domestic animals of the bovine species 7.

In paragraph (1) a “collection centre” or a “storage centre” means an establishment approved in accordance with Council Directive 88/407/EEC.

For Part V of Schedule 3, substitute—
PART VCRITERIA FOR ACCEPTANCE FOR BREEDING PURPOSES
Recognised organisations shall accept for breeding purposes bovines, and use ova and embryos, which satisfy the criteria specified in Council Directive 87/328/EEC on the acceptance for breeding purposes of pure bred breeding animals of the bovine species.
