The Department of Health, Social Services and Public Safety(1) makes the following Regulations in exercise of the powers conferred on it by Articles 15(1)(a), 16(1) and 47(2) of, and paragraph 1 of Schedule 1 to, the Food Safety (Northern Ireland) Order 1991(2).

In accordance with Article 47(3A) of that Order, it has had regard to relevant advice given by the Food Standards Agency.

As required by Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety(3) there has been open and transparent public consultation during the preparation and evaluation of these Regulations.

Citation and Commencement

1.  These Regulations may be cited as the Miscellaneous Food Additives (Amendment) Regulations (Northern Ireland) 2008 and come into operation on 7th March 2008.

Amendments to the Miscellaneous Food Additives Regulations (Northern Ireland) 1996

2.—(1) The Miscellaneous Food Additives Regulations (Northern Ireland) 1996(4) are amended in accordance with paragraph (2).

(2) In Schedule 8 (miscellaneous additives permitted in foods for infants and young children) —

(a)in Part III (miscellaneous additives permitted in processed cereal-based foods and baby foods for infants and young children in good health), omit the entry relating to E 473; and

(b)in Part IV (miscellaneous additives permitted in dietary foods for infants and young children for special medical purposes as defined in Directive 1999/21/EC), after the entry relating to E 472c insert —

E 473Sucrose esters of fatty acids120 mg/lProducts containing hydrolysed proteins, peptides and amino acids

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations further amend the Miscellaneous Food Additives Regulations (Northern Ireland) 1996 (S.R. 1996 No.50 as amended) (“the Additives Regulations”) in order to rectify an error caused by a defect in the Miscellaneous Additives and the Sweeteners in Food (Amendment) Regulations (Northern Ireland) 2007 (S.R. 2007 No.325).

The entry for one substance in Schedule 8 of the Additives Regulations is removed from Part III of that Schedule and added to Part IV.
