Criminal Justice (Northern Ireland) Order 2008 (Consequential Provision) Order 2009

The Secretary of State considers it necessary in consequence of Article 14 of the Criminal Justice (Northern Ireland) Order 2008(1) to make the following Order. The Secretary of State makes the following Order in exercise of the powers conferred by Article 101 of the Criminal Justice (Northern Ireland) Order 2008.

Citation and Commencement

1.  This Order may be cited as the Criminal Justice (Northern Ireland) Order 2008 (Consequential Provision) Order 2009 and shall come into operation on 15th May 2009.

Amendment of the Treatment of Offenders Act (Northern Ireland) 1968

2.—(1) The Treatment of Offenders Act (Northern Ireland) 1968 (2) is amended as follows.

(2) In section 26(2) after “young offenders centre” insert “or sentence of detention under Article 14(5) of the Criminal Justice (Northern Ireland) Order 2008”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends section 26(2) the Treatment of Offenders Act (Northern Ireland) 1968. The amendment is consequential on the introduction of sentences of detention under Article 14(5) of the Criminal Justice (Northern Ireland) Order 2008. The effect of the amendment is that offenders sentenced to terms of detention under that provision will have their sentence reduced by any relevant period of pre-sentence custody in the same way as those sentenced to terms of imprisonment or detention in a young offenders centre.
