PART 2N.I.Groundwater assessment

[F1Criteria and Procedure for assessing groundwater chemical statusN.I.

9.(1) The Department shall apply the approach in the relevant provisions of the Directive and the Water Framework Directive when assessing groundwater chemical status.

(2) The relevant provisions of the Directive for the purposes of [F2paragraph] (1) are—

(a)Article 3(1)(a) and (b);

(b)Article 3(6);

(c)Article 4(1), 4(2) and 4(3);

(d)Annex I;

(e)Annex II; and

(f)paragraphs 1 to 4 of Annex III.

(3) The relevant provisions of the Water Framework Directive for the purposes of [F3paragraph] (1) are in section 2.3 of Annex V.

(4) Diffuse sources of pollution having an impact on groundwater chemical status must be taken into account whenever technically possible.]
